This Privacy Policy (the “Policy”) explains how Children’s Cancer Association d/b/a JoyRx, together with any affiliates, subsidiaries, successors, and assigns (together, “CHILDREN’S CANCER ASSOCIATION,” “us,” “our,” and “we”) collects, stores, uses, and discloses personal information, including when you (1) actively enter information into the website located at joyrx.org (the “Website”), (2) participate in events, (3) engage with us on social media, (4) support us by making a donation, (5) sign up to volunteer, or (6) communicate with us. CHILDREN’S CANCER ASSOCIATION may provide notification of significant changes to this Policy through the Website. CHILDREN’S CANCER ASSOCIATION processes personal information deemed ‘sensitive’ under certain laws. We may request this information from you to provide personalized services, resources, or recommendations to you or your family, to ensure our organization is meeting the needs of our diverse community, or other legitimate purpose. You may provide such information directly to us, for example by filling out a survey, or we may obtain such information in the context of our activities in meeting our mission. This may include personal information that reveals your racial or ethnic background, religious believes, mental or physical condition or diagnosis, sexual orientation, status as transgender or nonbinary, status as a victim of crime or citizenship or immigration status;

CHILDREN’S CANCER ASSOCIATION uses certain digital analytics tools, such as cookies, on the Website that help us gather personal information that we use to analyze site usage and performance. The information we collect automatically typically does not include any individuals’ names or contact information. Rather, the personal information about your visit to and use of the Website is collecting using a unique identifier, and may include:

HOW WE USE YOUR PERSONAL INFORMATION

CHILDREN’S CANCER ASSOCIATION uses personal information for a variety of purposes related to our mission. This includes performing our services; responding to contact inquiries; processing donations; sending out newsletters and mailings; and facilitating and running events, sweepstakes, and other activities.

If you subscribe to our distribution list, we use the personal information you provide for a variety of purposes related to our mission. If you apply for a job, internship, or volunteer position with CHILDREN’S CANCER ASSOCIATION, we will use the information you provide with your application to consider you for the position for which you apply. At times and when required by law, we may also use your personal information to contact you regarding your use of the website, and/or to provide required notices.

Our reasons for processing your information:

Achieving our Mission

We use your information to achieve our mission, which is to prescribe joy through programs that create immediate and measurable improvement to the mental and emotional wellness of seriously ill children. We use your information to carry out our programs, develop content and resources, organize and recognize volunteers and donors, and to spread awareness of the services we provide. For example, if you inquire about mentorship, we may share your information with mentors in your area. We also use your information to connect you with volunteers or other services providers, at your direction. For example, if you share a need, we may ask if we can share your information with an organization or person who may be able to help.

Fundraising

CHILDREN’S CANCER ASSOCIATION uses personal information for fundraising purposes, which enables us to help seriously ill kids and their families. We use your information to contact you to donate, thank you for your donation, recognize you, and invite you to get involved. You can request that we not contact you for fundraising purposes. Depending on the nature of our relationship with you, we may still contact you for other purposes as necessary or permitted.

Marketing

CHILDREN’S CANCER ASSOCIATION may use personal information for marketing purposes. For example, if you inquire about CHILDREN’S CANCER ASSOCIATION events or sweepstakes, we may use your personal information to contact you to discuss your interest in CHILDREN’S CANCER ASSOCIATION and the services that we provide and send you information regarding CHILDREN’S CANCER ASSOCIATION, which may include information about promotions, volunteer opportunities, or events. Recruiting

As described above, if you are interested in employment or career opportunities with CHILDREN’S CANCER ASSOCIATION we will ask you to provide certain personal information required for the application and recruiting process. We use a third-party applicant tracking service to assist us with processing online job applications and related materials. Such service provider only processes your information on our behalf. CHILDREN’S CANCER ASSOCIATION receives all of the personal information you provide as part of your online portfolio and the job applications you submit.

We use your personal information as necessary to operate our organization. For example, we use personal information to protect and defend our rights and property, as well as those of others if we have a reasonable belief such use is necessary to prevent harm. However, while we can instruct the non-profits with whom we share the personal information to hold or use the information only in certain ways, we cannot guarantee how those organizations will ultimately hold or use the personal information.

CHILDREN’S CANCER ASSOCIATION may disclose, or allow access to, your personal information to third-party service providers and vendors to perform certain services for us and/or help us provide certain services to you, including:

  • To perform certain marketing activities on our behalf, such as through promotional e-mail campaigns, social media interactions, and other digital marketing technologies (such marketing activities may include use of aggregate data to develop donor profiles in an effort to identify additional individuals who are interested in donating to CHILDREN’S CANCER ASSOCIATION);

Cookies and Similar Technologies

As described above, we provide certain social features on the Website. These features might require us to implement cookies, plug-ins, or application programming interfaces (APIs) provided by third parties or other platforms to facilitate the communications and features. When you use such features, your information will be collected by the third party or social media platform. Their use of your information is subject to their relevant privacy policies, over which CHILDREN’S CANCER ASSOCIATION has no responsibility or control. We cannot control any policies or terms of such third party platforms. As a result, we cannot be responsible for any use of your information or content by a third party social media platform, which you disclose at your own discretion. We encourage you to review the privacy policies and practices of any social media platforms prior to use.

CHILDREN’S PRIVACY

Only some parts of the Website, those which allow Users to watch music videos, learn to play songs, and play music-themed games, are intended for use by children, including children under the age of 13 (the “Children’s Music Section”). Except for in the Children’s Music Section, we do not intend to or knowingly collect the personal information of children under the age of 13.

In the Children’s Music Section, we collect personal information, including potentially the personal information of children under the age of 13, when Users create a profile through which to access the music videos, music lessons, and games available in the Children’s Music Section. During the profile-creation process, we ask for the User’s first name, birthday, and a user name, and if the birthday selection indicates the User is under 13, we request their parent or guardian’s email address so that we may seek permission from the parent or guardian to use the child’s personal information in accordance with this Privacy Policy. We do not require children, including those under the age of 13, to disclose more personal information than is reasonably necessary for them to take advantage of the Children’s Music Section.

Like other parts of the Website, the Children’s Music Section uses Google Analytics to collect personal information about interactions with the Website. In the Children’s Music Section, we use the personal information to understand what content children are using and optimize the Website.

If you are a parent or guardian of a child under the age of 13 from whom we have collected personal information, you have certain rights with respect to that child’s personal information. Specifically, parents and guardians of children under the age of 13 have the right to:

  • Review the personal information we keep about their child, request that we delete that personal information, and refuse to allow us to either collect any further personal information about that child or continue to use that personal information; and

  • Request that, even if we may collect and otherwise use the child’s personal information, we not disclose that personal information to any third parties except as necessary to provide the content in the Children’s Music Section.

To exercise these rights, please contact us via the Contact Form on the Website or by email at privacy@joyrx.org, and identify the child about whom you are contacting us. Please note, that for the child’s safety and compliance with law, we will need to verify your identity if you attempt to exercise your rights under this section. If you have reason to believe that a child under the age of 13 has provided personal information to us through any means other than the Children’s Music Section, or without their parent or guardian’s consent, we encourage the child’s parent or guardian to contact us via the Contact Form on the Website or by email at privacy@joyrx.org to request that we remove the information from our systems. If we learn that we have received personal information from a child under the age of 13 through any means other than the Children’s Music Section, or without their parent or guardian’s consent we will delete that information from our files.

SECURITY OF COLLECTED INFORMATION

CHILDREN’S CANCER ASSOCIATION uses commercially reasonable physical, electronic, and administrative security measures to assist in protecting against the loss, misuse, and unauthorized alteration of personal information that is under our control. Unfortunately, no data storage system, or system of transmitting data over the Internet or wireless network, can be 100% secure, and no security system can prevent all security breaches. As a result, we do not and cannot guarantee the security of our servers or our network, the means by which personal information is transmitted to us, or any personal information provided to us or to a third party in connection with your use of the Website or when you interact with us.

DO NOT TRACK

The Website uses some cookies that persist and may track your activities after you have left the Website. The Website does not at this time respond to browser “Do Not Track” signals. As described in this Privacy Policy, ‎the Website may contain links to other sites or services not owned or operated by CHILDREN’S CANCER ASSOCIATION. These ‎websites ‎may set cookies that obtain information about the fact that a web browser visited the Website from a ‎certain IP address. CHILDREN’S CANCER ASSOCIATION does not and cannot control whether such third-party sites collect any Personal Information from you if you navigate to these sites from the ‎Website.‎

RETENTION, STORAGE AND REMOVAL

We may retain all personal information in our databases for as long as necessary to perform the business purposes for which we’ve collected it, or until you ask us to remove your information from our databases in accordance with applicable laws, rules, or regulations, and unless applicable laws require otherwise. When we have no ongoing legitimate business need to process your Personal Information, we will ‎either delete or aggregate it, or, if this is not possible (for example, because your personal ‎information has been stored in backup archives), then we will securely store your personal ‎information and isolate it from any further processing until deletion is possible. Note that even after you ask us to remove your information from our databases, it may be impossible to remove some information, such as information tracked in our web server log files and information that may reside in backup files. This residual information is retained to preserve the integrity of our backed-up files and for business continuity purposes. We may retain aggregate data to analyze and improve the Website.

Further, even after you request that we remove your information from our databases, we may retain personal information to comply with any applicable law, rule, regulation, or guideline; to prevent fraudulent activity; to protect ourselves against liability; and to allow us to enforce our contractual or other rights and to pursue available remedies and limit any damages we may sustain.
